Liberal political philosophy emphasizes the benefits of membership in a cultural group and, in the opinion of this challenging book, neglects its harmful, oppressive aspects. Andrew Kernohan argues that an oppressive culture perpetuates inegalitarian social meanings and false assumptions about who is entitled to what. Cultural pollution harms fundamental interests in self-respect and knowledge of the good and is diffuse, insidious, and unnoticed. This cultural pollution is analogous to environmental pollution, and though difficult to detect, is nonetheless just as real. (...) Both the Sarbanes–Oxley Act of 2002 and the Dodd-Frank Act of 2010 include clawback provisions that require executives to pay back incentive compensation earned on financial statements that are restated in a subsequent period. Such provisions intend to reduce unethical reporting behavior by executives who otherwise might be more inclined to misstate financial statements to boost incentive-based compensation. However, such provisions could promote rather than deter unethical behavior. In particular, Pyzoha :2515–2536, 2015) finds that, under certain conditions, executives are less (...) willing to restate financial statements in the presence of a clawback policy. Similarly, auditors might also act unethically by being less likely to propose restatements in the presence of clawbacks to avoid upsetting management. To examine this possibility, this study reports the results of three experiments that examine the effect of clawback provisions on auditor judgment. Contrary to expectations, our three experiments, along with supplemental qualitative evidence consistently indicate that clawbacks do not affect auditors’ propensity to propose restatements. These results suggest that a decrease in the number of restatements in a clawback environment will not be due to auditors acting unethically to appease management. The effects of clawbacks on auditors’ risk assessments, however, are less conclusive. As such, we offer potential post hoc explanations to guide future research. (shrink)

This study examines how codes of conduct, monitoring, and penalties for dishonest reporting affect reporting honesty in an online labor market setting. Prior research supports the efficacy of codes of conduct in promoting ethical behavior in a variety of contexts. However, the effects of such codes and other methods have not been examined in online labor markets, an increasingly utilized resource that differs from previously examined settings in several key regards (e.g., transient workforce, lack of an established culture). Leveraging social (...) norm activation theory, we predict and find experimental evidence that while codes of conduct and monitoring without economic penalties are ineffective in online settings, monitoring with economic penalties activates social norms for honesty and promotes honest reporting in an online setting. Further, we find that imposing penalties most effectively promotes honest reporting in workers who rate high in Machiavellianism, a trait that is highly correlated with dishonest reporting. In fact, while in the absence of penalties we observe significantly more dishonest reporting from workers who rate high versus low in Machiavellianism, this difference is eliminated in the presence of penalties. Implications of these findings for companies, researchers, online labor market administrators, and educators are discussed. (shrink)

This essay explores different conceptions of freedom in Kant, Green, and their critics. Kant introduces three kinds of freedom—negative freedom, positive freedom or autonomy, and transcendental freedom. Sidgwick objects that Kant's conception of positive freedom is unable to explain how someone might be free and responsible for the wrong choices. Though Green rejects transcendental freedom, he thinks Kant's conception of practical freedom can be defended by identifying it with the capacity to be determined by practical reason. Green identifies his own (...) tripartite conception of freedom—juridical freedom, moral freedom, and real freedom. He thinks that these are stages in the perfection of freedom. Green's tripartite conception provides a principled reply to Berlin's doubts about positive freedom, explains Kant's claims that respect and esteem are fitting attitudes toward different aspects of freedom, and supports Schiller's criticisms of Kantian freedom and virtue. Green's conception of freedom defends the best elements of the Kantian perspective while addressing legitimate worries. In doing so, it unifies different aspects of freedom in a way that is grounded in moral personality or rational nature. (shrink)

This volume collects David Lyons' well-known essays on Mill's moral theory and includes an introduction which relates the essays to prior and subsequent philosophical developments. Like the author's Forms and Limits of Utilitarianism (Oxford, 1965), the essays apply analytical methods to issues in normative ethics. The first essay defends a refined version of the beneficiary theory of rights against H.L.A. Hart's important criticisms. The central set of essays develops new interpretations of Mill's moral theory with the aim of determining how (...) far rights can be incorporated in a utilitarian framework. They Mill's analysis of moral concepts promises to accommodate the argumentative force of rights, and also provide a significant new reading of Mill's theory of liberty. The last essay argues that the promise of Mill's theory of justice cannot be fulfilled. Utilitarianism is unable to account for crucial features of moral rights, or even for the moral force of legal rights whose existence might be justified on utilitarian grounds. (shrink)

Perfectionism is an underexplored tradition, perhaps because of doubts about the grounds, content, and implications of perfectionist ideals. Aristotle, J.S. Mill, and T.H. Green are normative perfectionists, grounding perfectionist ideals in a normative conception of human nature involving personality or agency. This essay explores the prospects of normative perfectionism by examining Kant’s criticisms of the perfectionist tradition. First, Kant claims that the perfectionist can generate only hypothetical, not categorical, imperatives. But insofar as the normative perfectionist appeals to the normative category (...) of personality or agency, rather than a biological category of humanity, it can represent perfectionist demands as categorical imperatives. Second, Kant accepts a moral asymmetry in which we aim at our own perfection but at the happiness, rather than the perfection, of others. However, the importance of autonomy in normative perfection explains why the perfectionist should recognize a self/other asymmetry. Indeed, when we see how the normative perfectionist can answer Kant’s criticisms while respecting Kant’s own claims about the connection between rational nature and moral requirements, we can see the basis for a normative perfectionist interpretation of Kant’s own ethical theory. Insofar as Kantians and normative perfectionists both base ethical demands on an appeal to rational nature, they face a common worry that the appeal to rational nature is empty or incomplete. Normative perfectionists have more and less concessive responses to this worry, providing perfectionist explanations of various apparently non-perfectionist goods. Even if we end up being pluralists about the good, perfectionist elements play an important role. Finally, because the normative perfectionist, like the Kantian, grounds its ideals and requirements in a conception of persons as rational agents, it provides a promising account of the rational authority of perfectionist demands. This comparison of normative perfectionist and Kantian essentials gives us reason to take the normative perfectionist tradition seriously. (shrink)

In 1943 one of the authors of this paper set out a case for the view that the sixth book of Polybius' Histories contained two layers, written at different times, and indicating a change in the historian's assessment of the achievements and merits of the Roman hegemony. The arguments there put forward met with some acceptance; but the recent burst of interest in the problems of the sixth book has shown that unanimity is still remote. Among scholars writing since 1943, (...) one, G. B. Cardona, is a ‘separatist’ who accepts the views of De Sanctis; another, W. Theiler, believes that three ‘layers’ of composition can be detected and isolated; three, E. Mioni, H. Erbse, and H. Ryffel, are ‘Unitarians’, but vary in the date they assign to the composition of the Histories; and K. Wells (1866-1946) contemplates the belief systems, prejudices, and institutions that have brought humankind to a dreadful impasse, where it stands at the brink of destruction - or of a new beginning. In his lucid summary of modern ideas concerning the fundamentals and ultimates of existence, Wells points out how absurd and outmoded religious beliefs, marked by intolerance, hatred, and exclusion, have poisoned human beings' relations (...) with the world and each other. A father brings his six-year-old daughter and her older sister to their pediatrician to be evaluated for a history of cough, runny nose, and low-grade fever. In addition to signs of a cold, the girl's nasal bridge is quite swollen and bruised. When asked how her nose was injured, she shrugs, and her father's only conjecture is that she sleepwalks and might have bumped into something. The father sits impatiently and as questioning progresses becomes increasingly defensive, at one point angrily (...) declaring, “We don't beat our kids, if that's what you’re asking.” Further complicating the situation is information from nurses that this family is “on the brink” socially and financially, and that additional stress is likely “to blow this family apart.” A careful physical exam identifies no other injuries, and a thorough review reveals no evidence of prior suspicious injuries, frequent visits to the emergency room, or bleeding abnormalities. The evidence does not point to abuse as the most likely explanation for the injury, but it clearly is not ruled out. Should one report this family for suspected abuse? Is one required to report? Post-school education in South Africa mostly takes place within an industrial-age factory environment as has been done for the past 50 years or longer. This is the case despite the fact that the world is on the brink of, or already part of, the Fourth Industrial Revolution, called by some an ‘emerging new world order’. Educating students today like we did it half a century ago has now become education to a ‘quickly vanishing world’. Although one may argue that (...) the content of Theology will not be much affected by the 4IR, it is proposed that the way in which that content is communicated and educated should change drastically. Doing this will prepare our students to become relevant preachers or theologians in the current postmodern society. The proposed model in this article is called an outside-in model – contrasted to the current inside-out model of education – in which our students should be taught to develop a sense of deep learning, to effectively learn and work in and with groups, to use their mobile devices and social media within the environment of education and to discuss new ways of gathering God’s people.The question that each educator should ask themselves nowadays is: Am I really preparing my students for the future that they are facing?Contribution: A new way of teaching Theology in the 4IR is imperative for our students. This article suggests how it could be done. Although this entails willpower and persuading the mostly ‘old’ lecturers in Theology to engage with real technology, it is all about the student, because many of these students will become the lecturers of tomorrow. Our faculties or departments of Theology are therefore urged to fit themselves into the new mould and to train our future theologians in a 4IR way. (shrink)

There are a number of problematic features within the current treatment of time in physical theories, including the “timelessness” of the Universe as encapsulated by the Wheeler–DeWitt equation. This paper considers one particular investigation into resolving this issue; a conditional probability interpretation that was first proposed by Page and Wooters. Those authors addressed the apparent timelessness by subdividing a faux Universe into two entangled parts, “the clock” and “the remainder of the Universe”, and then synchronizing the effective dynamics of the (...) two subsystems by way of conditional probabilities. The current treatment focuses on the possibility of using a realistic clock system; namely, a coherent-state description of a damped harmonic oscillator. This clock proves to be consistent with the conditional probability interpretation; in particular, a standard evolution operator is identified with the position of the clock playing the role of time for the rest of the Universe. Restrictions on the damping factor are determined and, perhaps contrary to expectations, the optimal choice of clock is not necessarily one of minimal damping. (shrink)

BackgroundReducing the number of animals used in experiments has become a priority for the governments of many countries. For these reductions to occur, animal-free alternatives must be made more available and, crucially, must be embraced by researchers.MethodsWe conducted an international online survey for academics in the field of animal science (N = 367) to explore researchers’ attitudes towards the implementation of animal-free innovations. Through this survey, we address three key questions. The first question is whether scientists who use animals in (...) their research consider governmental goals for animal-free innovations achievable and whether they would support such goals. Secondly, responders were asked to rank the importance of ten roadblocks that could hamper the implementation of animal-free innovations. Finally, responders were asked whether they would migrate (either themselves or their research) if increased animal research regulations in their country of residence restricted their research.ResultsWhile nearly half (40%) of the responders support governmental goals, the majority (71%) of researchers did not consider such goals achievable in their field within the near future. In terms of roadblocks for implementation of animal-free methods, ~ 80% of the responders considered ‘reliability’ as important, making it the most highly ranked roadblock. However, all other roadblocks were reported by most responders as somewhat important, suggesting that they must also be considered when addressing animal-free innovations. Importantly, a majority reported that they would consider migration to another country in response to a restrictive animal research policy. Thus, governments must consider the risk of researchers migrating to other institutes, states or countries, leading to a ‘brain-drain’ if policies are too strict or suitable animal-free alternatives are not available.ConclusionOur findings suggest that development and implementation of animal-free innovations are hampered by multiple factors. We outline three pillars concerning education, governmental influence and data sharing, the implementation of which may help to overcome these roadblocks to animal-free innovations. (shrink)
